You would not be prosecuted for accidentally damaging a great crested newt or it's habitat, but as you know that they are there, you will be expected to take reasonable steps to protect them and their habitat. If you do not take reasonable steps to do so, your actions will probably not be seen as accidental, but reckless and therefore you will be legally liable.
