Looks Like Bay Laurel - Laurus nobilis to me - the yellow things hanging in the picture had me foxed as they look like lemons but I think that they are actually yellowing leaves. The black berries look a bit like shiney olives on the tree but tend to be a bit pointed when you get a closer look. Well that's my stab at what it is anyway.....

Thanks for your opinion - I was actually beginning to think the same myself - but I couldn't believe that it could get to that size - its well over 4 metres tall - possibly even over 5metres! I should imagine its upwards of 125 years old as it was probably planted in Victorian times (due to where it is). The leaves don't really smell from one that I tested (branches out of reach!), although the leaf I had collected was on the floor and yellowing so hardly a fair test. The "berry" on it is a little larger than a 1p coin in diameter and is perfectly spherical rather than oval...
You are correct that the yellow things are yellowing leaves, although as that picture was taken yesterday, I think its safe to say that its an evergreen tree whatever it is.
